Terms and Conditions

General

1. This lounge strictly adheres to membership admission rules and only grants entry to individuals aged 18 and above.


2. We reserve the right to refuse entry to individuals under the age of 18, even if they have an existing membership account. It is your responsibility to ensure that you are 18 or older before completing the account signup process.


3. Account registration requires a valid mobile number, and OTP verification is mandatory. Sharing of accounts is strictly prohibited.


4. The annual membership fee is RM199, valid for one year (365 days), and renewal is required.


5. All secret points that have been successfully reloaded into wallet accounts are non-refundable, non-transferable, and non-exchangeable for cash. RM 1 = 1 Secret Point.


6. It is mandatory to present the QR code at the reception for check-in, collect the entry card, and return the card to the reception for check-out before exiting the lounge.


7. Scanning check-out at the reception is required before exiting the lounge. Wallet calculations will only cease upon successful check-out scanning. In the event of failure to check-out, whether due to forgetfulness or other unspecified reasons, you shall be solely responsible for any resulting losses.


8. It is mandatory to return the card to the reception upon check-out. A penalty RM100 may be imposed if the card is not returned, lost, or damaged in a way that makes it unusable (e.g., scratches, bent marks, or any other etc.). Compensation shall be paid for the cost of card replacement.


9. ⁠There are different entry charges for private rooms and lounge areas. Private room prices are based on on-site availability.


10. The charges for lounge areas are RM18 per hour, with a mandatory fee of RM18 for the first hour. Subsequent charges are RM9 for every half-hour.


11. Complimentary cigars (first 25 sticks) are exclusively a benefit for newly joined members. Membership renewals are not eligible, but you may continue to enjoy various benefits after accumulating 50 hours of spending.


12. Complimentary cigars (first 25 sticks) from the new member benefits will be valid for 365 days and will be forfeited on the day of membership expiry, regardless of renewal. No carry-forward is allowed.


13. ⁠Only members can enjoy the benefits of accumulating 50 hours of spending. Complimentary cigars obtained through this accumulation can be claimed as long as the membership status is valid, with no expiry date for claims.


14. The spending 50 hours member benefits program is valid for accumulation and calculation for hosts in the private room booking only, and it is not applicable to guests. For example, a private room booking of 3 hours accumulates 3 hours specifically for the hosts only.


15. ⁠A maximum of 3 cigar sticks can be redeemed in a day, whether as benefits for newly joined members or through the accumulation of 50 hours of spending. Each stick can only be redeemed at least 1 hour after the previous one, or the first stick must be finished before claiming the next (whichever comes first). The last call for redeeming cigars is every day before 11:00 PM.


16. ⁠If a member brings a guest, the guest can enter by purchasing a Guest Pass Entry Rate at an hourly rate of RM25. This entry includes access to facilities on the premises, unlimited drinks, and titbits. Guests may also bring their own cigars at no additional charge; however, please note that cigars are not complimentary, and the member's complimentary cigars cannot be shared with the guest.


17. Purchased a Guest Pass entry is not entitled for the member benefits of the accumulation of spending 50 hours or any other member-exclusive perks.


18. Mystery gifts and any complimentary gifts received during an event are not eligible for cash exchange or transfer to other members.


19. Complimentary cigars are not allowed to be taken away, exchanged for cash, or transferred to other members. Once redeemed, changes in the cigar flavor are not permitted.


20. We reserve the right to forfeit complimentary cigars or mystery gift at any time if we find out that a member has misused our member benefits program.


21. This is a self-service lounge with operating hours from Monday to Saturday, 12:00 PM to 12:00 AM. It is exclusively for cigar smokers; other types of tobacco (e.g., vaping, cigarettes, or any other etc.) are strictly prohibited.


22. The menus presented on the Cigar Secret APPs/Website do not pertain to Cigar Secret lounge. The Cigar Secret APPs/Website provides optional services exclusively for its members, without assuming any benefits. The Cigar Secret lounge explicitly disclaims responsibility for any incidents, placing the onus on both the respective restaurants and the members themselves. By opting to place an order with the restaurant, you acknowledge and accept full responsibility for any ensuing consequences.


23. We kindly remind you to avoid unnecessary wastage of food and drinks during your visit. Our commitment to sustainability is integral to our values, and we seek your cooperation in minimizing any excess. A penalty RM5/per gram may be imposed for significant food and drinks wastage. This measure is introduced to encourage responsible consumption and aligns with our dedication to sustainability.


24. You are welcome to bring your own cigars to enjoy in the lounge at no extra charges. However, if you wish to bring your own alcoholic beverages, a supplementary fee of RM10 per person applies.


25. All of those items belong to the lounge and are meant to remain in the lounge. Taking away any goods or items from the lounge is strictly prohibited.


26. Please ensure that all the furniture and items belonging to the lounge are used and kept in good condition without taking away. In the event of loss, breakage, or damage that makes it unusable (e.g., broken glass or any other items.), you will be responsible for compensating for the loss.


27. Please take care of your belongings and do not leave them unattended. The Cigar Secret lounge disclaims any liability and is not accountable for any losses incurred.


28. In the spirit of maintaining a pleasant and respectful environment for everyone, we kindly remind all members to be mindful of their conduct while in the lounge. We believe that mutual respect enhances the overall experience for each individual. Your cooperation is highly appreciated, and we thank you for being a valued member of our lounge community.


29. In these Terms and Conditions 'We/us/our/APPs/website/lounge' means Cigar Secret and 'You/your' means you as a member of the APPs/Website.


30. You shall not use the APPs/Website for any illegal purposes, and you will use it in compliance with all applicable Laws and Regulations. You agree not to use the APPs/Website in a way that may cause the APPs/Website to be interrupted, damaged, rendered less efficient or such that the effectiveness or functionality of the APPs/Website is in any way impaired;


31. You agree not to attempt any unauthorized access to any part or component of the APPs/Website; and you agree that in the event that you have any right, claim or action against any Members arising out of that Member's use of the APPs/Website, then you will pursue such right, claim or action independently of and without recourse to us.


32. You agree to be fully responsible for (and fully indemnify us against) all claims, liability, damages, losses, costs and expenses, including legal fees, suffered by us and arising out of any breach of the Conditions by you or any other liabilities arising out of your use of the APPs/Website, or the use by any other person accessing the APPs/Website using your mobile or internet access account.


33. We reserve the right to modify or withdraw, temporarily or permanently, the APPs/Website (or any part of) with or without notice to you and you confirm that we shall not be liable to you or any third party for any modification to or withdrawal of the APPs/Website.


34. We may alter these Terms and Conditions from time to time, and your use of the APPs/Website (or any part of) following such change shall be deemed to be your acceptance of such change. It is your responsibility to check regularly to determine whether the Conditions have been changed. If you do not agree to any change to the Conditions then you must immediately stop using the APPs/Website.


35. The APPs/Website is subject to constant change. You will not be eligible for any compensation because you cannot use any part of the APPs/Website or because of a failure, suspension or withdrawal of all or part of the APPs/Website.


36. We are not responsible for the availability of any external sites or resources, and do not endorse and are not responsible or liable, directly or indirectly, for the privacy practices or the content (including misrepresentative or defamatory content) of any third party APPs/Website, including (without limitation) any advertising, products or other materials or services on or available from such APPs/Websites or resources, nor for any damage, loss or offence caused or alleged to be caused by, or in connection with, the use of or reliance on any such content, goods or services available on such external sites or resources.


37. We have the right, but not the obligation, to monitor any activity and content associated with the APPs/Website. We may investigate any reported violation of these Conditions or complaints and take any action that we deem appropriate (which may include, but is not limited to, issuing warnings, suspending, terminating or attaching Conditions to your access and/or removing any materials from the APPs/Website).


38. You acknowledge and agree that all Copyright, Trademarks and all other intellectual property rights in all material or content supplied as part of the APPs/Website shall remain at all times vested in us or our licensors. You are permitted to use this material only as expressly authorized by us.


39. You acknowledge and agree that the material and content contained within the APPs/Website is made available for your personal non-commercial use only and that you may download such material and content onto only one mobile for such purpose. Any other use of the material and content of the APPs/Website is strictly prohibited. You agree not to (and agree not to assist or facilitate any third party to) copy, reproduce, transmit, publish, display, distribute, commercially exploit or create derivative works of such material and content.


40. We make no warranties, whether express or implied in relation to the accuracy of any information we place on the APPs/Website. The APPs/Website is provided on an 'as is' and 'as available' basis without any representation or endorsement. Unless specified in separate Terms and Conditions related to a particular product or service, we make no warranties of any kind, whether express or implied, in relation to the APPs/Website, or products or services offered on the APPs/Website whether by us or on our behalf (including free software downloads) including but not limited to, implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security, accuracy, condition or completeness, or any implied warranty arising from course of dealing or usage or trade.


41. Unless specified in separate Terms and Conditions related to a particular product or service, we make no warranty that the APPs/Website or products or services offered on the APPs/Website whether by us or on our behalf (including free software downloads) will meet your requirements or will be uninterrupted, timely, secure or error-free, that defects will be corrected, or that the APPs/Website or the server that makes it available or products or services offered on the APPs/Website whether by us or on our behalf (including free software downloads) are free of viruses or bugs or are fully functional, accurate, or reliable. We will not be responsible or liable to you for any loss of content or material as a result of uploading to or downloading from the APPs/Website.


42. You acknowledge that we cannot guarantee and therefore shall not be in any way responsible for the security or privacy of the APPs/Website and any information provided to or taken from the APPs/Website by you.


43. We will not be liable, in contract, tort (including, without limitation, negligence), pre-contract or other representations (other than fraudulent misrepresentations) or otherwise out of or in connection with the APPs/Website or products or services offered on the APPs/Website whether by us or on our behalf (including free software downloads) for any economic losses (including without limitation loss of revenues, profits, contracts, business or anticipated savings) or any loss of goodwill or reputation, or any loss or corruption of data, or any special or indirect or consequential losses; in any case whether or not such losses were within the contemplation of either of us at the date on which the event giving rise to the loss occurred.


44. We will not be liable in contract, tort or otherwise if you incur loss or damage connecting to the APPs/Website through a third party's hypertext link.


45. By accessing this Cigar Secret APPs/Website, you agree to be bound by the Terms and Conditions appearing in this APPs/Website and Cigar Secret lounge.
